The United States believes that the South China Sea is an international water and the sovereignty of this area should be determined by the United Nations Convention on the Law of the Sea (UNCLOS). "The UN Convention on the Law of the Sea" stipulates that the country can not have sovereignty over the land that was flooded at the time of high tide or land that rose above the maximum water level due to construction. Dominating the South China Sea will allow China to dominate the majority of imported oil 's major trade routes. It will also allow China to destroy or interfere with the transport of goods to all countries in East Asia and Southeast Asia and refuse to contact foreign troops, especially the United States.

In 1982, the United Nations held the United Nations Conference on the Law of the Sea (UNCLOS) for signature. The United Nations Convention on the Law of the Sea is a major international agreement on the use and protection of the sea. By the middle of the 20th century, an international agreement on the use of the sea was required.
