In order to establish a more perfect alliance, establish justice, secure domestic quietness, promote general welfare, and to ensure the grace of freedom to ourselves and their descendants
One of America 's greatest contributions to the world is the US Constitution, perhaps the most influential part of the US Constitution is its preface. Therefore, tracking its origin and legal status is particularly meaningful. The current preamble is different from the first preface published at the Philadelphia conference in 1787. The first preface did not include the famous phrase "we are American people" and contained the state as the source of authority; it did not specify the purpose of the Constitution.
The preamble of the US Constitution is convincing, symbolic, and usually has no legal effect, so it is an example of Plato's preamble concept. The preamble of the Canadian rights and freedom charter is an example of the opposite of a persuasive, non-legally binding preamble. Another reason, unlike Plato's preface, may be that the preamble of the Canadian charter is not convincing value. In particular, it does not provide a compelling explanation for the unusual "God is the best". Interestingly, when discussing the legal status of the preamble of the 1867 Constitution Act, the Supreme Court of Canada has reached a different conclusion. In order to judge whether the separation of Quebec is constitutionally effective, the court analyzed the contents of the preamble and decided the basic value of the Canadian constitution.
What is the preamble of the Constitution? And how is it classified? In formal terms, the preface constitutes an introduction to the Constitution and usually has the official title "Foreword" or its equivalent title of 1, and in other cases it does not seem to have a title. The official classification provides easy and technical identification of the preamble. In addition to the formal classification, the preamble can be identified by its content. In essence, the preface does not require a specific position in the Constitution, but rather requires specific content. 2 It introduces the history and the core principles and values of the state behind the establishment of the Constitution.
