The Underground Water System in Western Australia

0 Introduction The purpose of this report is to investigate the groundwater system in Western Australia and recommend it to the Minister of Environment and Water Resources. The report covers the source and storage of groundwater, the extraction and influence, the type of general pollution in groundwater, and the way to prevent pollution. Groundwater is one of the basic water sources in the environment of Western Australia and collects fresh water at various depths below the surface of the earth.

Depending on the state of the western region, the right to process the groundwater varies. Some states treat water related to tributary groundwater - surface water flow in the same way as the above surface water rights. This groundwater is included in the surface water rights priority system. Therefore, in order to manage water rights according to the priority system, the tributary groundwater extracted by the well is handled in exactly the same way as the stream movement of the stream. There may be a legal presumption that all groundwater is a tributary

Three theories of groundwater rights are constantly evolving, like surface water and riparian rights. The first theory called absolute proprietary theory comes from UK law and gives landowners the right to withdraw as much groundwater as they desire. According to the second theory known as American rule, landlords can withdraw groundwater as much as possible as a malicious purpose or in a wasteful way. This theory currently applies to most jurisdictions in the United States.
