In this article, we first outline two theoretical viewpoints leading to its structure, namely dialogue theory, law and economics. These views define the legal, economic and social factors of the purpose and operation of the CRTC. It then analyzes the role of CRTC in overseeing the telecommunications industry in Canada and the discussion of network neutrality issues. Then, in this paper, by analyzing four important incidents, we examine the general attitude of the judicial body concerning substantive examination to CRTC in detail. Finally, the principles and positions drawn from these incidents apply to cyber neutral issues in order for the court to decide whether such regulation can be deemed to be within the authority of the committee I will.
