The Posse Comitatus Act of 1878

1878 The "Comitatus Act" is federal law enacted by Congress in 1878 to limit the use of Air Force and Army's authority in the federal government's enforcement function of civil law. The law guarantees that private police institutions are directly responsible for all law enforcement functions within the United States and the military is responsible for fighting the US war abroad . In particular, if permitted, the military can only be used as a law enforcement agency within the United States. After the end of the civil war, "occupation law" was enacted in 1878 to eliminate federal forces from the southern region.

The president used the power of the army to impose many restrictions on American civilians. For example, the Third Amendment banned soldiers in family camps during the peaceful period, and the "Pose Law" in 1878 prohibited the federal government from hiring soldiers to enforce US law. Likewise, US law prohibits intelligence agencies from targeting US citizens. The national security law enacted by the Central Intelligence Agency (CIA) in 1947 explicitly prohibited the government from having "police, subpoena, law enforcement agency, or internal security function". The boundary between rational and unreasonable information gathering has long been domestic and domestic differences.
