Napster debate When I first heard the word "napster" I did not know what it was, I think maybe this is a new insult around my high school. Over time, I discovered that Napster is related to online music. I did not see too many reports on TV, and as I was interested, I decided to go online and check it. When I arrived at the site, I found that there was no sellable music, no albums, no lyrics. This is the same as most online music sites. Instead, there is a downloadable program that allows users to transfer music files to users.
The first peer-to-peer case is A & M Records v. Napster, 239 F.3 d 1004 (September 9, 2001). Here we will consider whether Napster is a secondary infringer on the ninth tour. First, the court considered whether Napster was responsible for copyright infringement. In order to take responsibility, Napster must participate in "encouraging or aiding individual actions that infringe". The court found Napster to be responsible for end user copyright infringement, as Napster "encouraged and supported deliberately infringing plaintiffs' copyright". The criteria applicable by the court is whether Napster is "having the right and ability to monitor infringing acts and having direct economic benefits for such conduct". The court denied all Napster defenses, including its legitimate use.
On February 12, 2001, the Federal Court of Appeals found that music exchange service Napster had to cease the use of copyrighted material for trading and the possibility of being liable for "alternative copyright infringement" I decided there was. As Napster of the 9th US Circuit Court of Appeals stated, "Users must be prohibited from obtaining copyrighted content through a list of songs archived by their service users." The battle is not over yet. The San Francisco Court of Appeals immediately filed a lawsuit on this matter. By August 18, 2001, Napster had to submit a written legal argument to the court. By September 8, 2001, the RIAA has to refute Napster's view. By September 12, 2001 Napster had to respond. The hearing will be held on the first trial date after September 12, 2001.
