Separation of Powers

"Trias Polishica" or "Distribution of power" was designed by Charles Rui de Second of 18-year-old French social and political philosopher Lara Bredate Montesquieu. His publication "Spirit of Law" is considered as one of the great works in the history of politics and law. It inspired "human rights declaration" and "the American constitution". Under his model, the political authority of the state is divided into legislative authority, administrative authority and jurisdiction. He argues that in order to promote freedom most effectively, he must separate these three powers and act independently.

Therefore separation of authority means to divide the government's responsibility into different departments and limit the core functions of any department to execute other departments. The aim is to prevent concentration of forces and to provide checks and balances.

The separation of power is the key to the operation of the US government, but there is no absolute separation of power or absolute lack of separation of power. Government authority and responsibility intentionally overlap, they are too complicated, interrelated and not well separated. Therefore, there is an inherent measure of competition and conflict between government agencies. Throughout the history of the United States, there was a wave of waves among government departments. Separation of power is defined as the doctrine that the country's political system divides its government's power into different systems. In theory, the idea of ​​separation of power is to avoid government agencies getting too much power to establish an arbitrary government system. Furthermore, no government agency should give up power to other agencies. Separation of authority ensures examination and balance among government departments, but this is not necessarily a harmonious relationship that may create tensions between government agencies. But separation of power ensures that government actions comply with the law and protects people's rights.
