Modern society is culturally diverse. This diversity may be the result of various historical and social processes that could affect the unity and efficiency of the criminal justice system. Colonization of indigenous peoples since the 15th century, followed by European colonization of Africa, and migration of immigrants after the Second World War contributed to this diversity in various ways. The growing importance of culture in the field of criminal law is closely related to human rights (especially rights of ethnic minority) and its concerns in the field of sociology and criminal science.
On the other hand, "cultural diversity" means diversity within a specific cultural system. The system consists of a shared core of more or less clearly defined instructions and beliefs. However, the group sharing this core is not a homogeneous group but a complex composed of subcultures of different sizes and subgroups. Each of these subgroups will experience and influence a wider range of socio-cultural reality in different ways, depending on different needs, needs, and the position of power and power relations. However, each of these populations consists of individuals that are similar at the same time and that are not similar to each other. In other words, the identity of the individual itself is a complex whole defined by the "membership" of countless groups.
