Change to the Jury System

There were several key demands to restore Queensland's jury system. The current jury system is outdated and Ian Turnball (2001) stated, "Our jury system is a far past legacy of England." However, in order to change, we need to investigate the history, strengths and weaknesses of the jury system. Then allow other strategies and recommendations to be discussed to improve the effectiveness system. After the Queensland Constitution was adopted in 1867, the jurisdiction of the jury was satisfied.

The jury system consists of twelve people who participate in crime and civic activities and make decisions on de facto issues. In the UK, the jury system has a history of about 800 years. When the jury system developed in the UK, those times were called the age of darkness, then the jury needed to investigate the case itself. Previously it was expected to be guilty or not guilty. If the jury fails to reach agreement after a certain period of time, it is permissible to decide the majority of 10-2 and the judge can decide whether to accept such a judgment.

In this report we will present a reform plan for so-called defects and jury trials, taking into account the historical precedent of the system and the current practices in the US and abroad. There are two types of judges, big judges and small judges. This report focuses on small juries or trial juries as the center of controversy. A small jury can be used for both civil and criminal cases. In criticism of the jury trial and amendment of the proposal, the two types of cases were distinguished. The jury is at the center of the American justice system. In all serious criminal cases, the accused has the right to be tried by the jury representative of the defendant community.
