Apprentice programs, including joint labor management apprenticeship programs, usually do not discriminate based on individual age. Age limits for practice programs are only valid under certain limited exceptions; if this is likely to affect you, please consult a lawyer. ADEA has nothing to expressly hinder the employer from asking for the applicant's age or date of birth. Discrimination based on individual age is illegal in the apprenticeship program (including joint labor management apprenticeship program). Age limits for practice programs are effective only when certain exceptions to ADEA are met or if EEOC allows specific exemption. ADEA does not explicitly prohibit employers from asking for applicant's age or date of birth. However, these investigations may indicate an intention to discriminate against age, which prevents older workers from applying for employment or otherwise goes against the purpose of ADEA. If you need this information for legitimate purposes you can obtain it after hiring an employee.

Registered apprenticeship program sponsors will determine the minimum eligibility applicable to their apprenticeship program. A qualified starting age must not be less than 16 years old, but individuals need to be at least 18 years old to become an apprentice of dangerous occupations. The sponsor of the program can also decide other minimum qualifications and certificates to apply, such as education, the ability to actually perform the basic functions of the profession, and proof of age. All applicants must meet minimum qualifications. Other eligibility criteria such as fairness tests, interviews, grade levels, past work experience can be decided based on the selection method used by the sponsor.
