American Express Company, et al. vs. Italian Color

A contract was signed between American Express and a merchant who accepts American Express. This card acceptance agreement contains clauses that require arbitration not based on categories for all disputes between the parties. A restaurant's owner Italian Color and other merchants are in a class action lawsuit alleging that American Express used exclusive rights to accept American Express cards at a higher price than other competitors answered. Businessmen argued that American Express violated Article 1 of the Sherman Act and put them together in an illegal arrangement.

The author of this paper believes that the case of Francisco Maestas et al. And George H. Shone et al. (1914) is one of the first challenges to American school isolation in the United States. This case was held in southern Colorado. Mexican Americans have a historical root here. This case is unique as the ethnic background and language needs of Mexican-American children are questioned. First, plaintiffs (Mexican Americans) regard the children as ethnically different from the Mexican, and have challenged apartheid using the Colorado Constitution. The defendant (committee member and director) argued that Mexican-American children were white and claimed that they were the same as other white children in the school district.
