A History of English Common Law

The common origins of England's common law in the twelfth century was caused by the death of Henry I in 1135. Henry 's nephew was Steven who was regarded as a legitimate king, but big men swore to Henry' s daughter Matilda. The whole reign of Stephen continued from 1135 to 1154 and fought with Matilda and her French husband. After the death of Steven, Matilda's son Henry II became king in 1154. Rather than allowing the king to handle all the problems of the feudal court, the king started to have a clear interest in the transactions of the court system and invested in the establishment of the royal system.

The American law originates mainly from the British common law tradition. By the time the American colonies uprised in the UK in 1776, the British common law tradition was well established in colonial courts. Common law in the UK is a system that uses written judicial decisions as domestic law. Therefore, if a British court expresses an opinion on the content of common law robbery, other courts will claim this decision to form a common legal system nationwide. Common law is basically an abbreviated representation of the concept of a common legal system based on written decisions of the past, which is desirable and necessary.

With the development of "common law" or case law, British legal history opened up a different path. In the common law law, the decisions made by the court on various matters so far were as important as the official regulations. In addition to the content of certain laws, there are no other powers in the courts of the civil code system. In the common law court, judicial decisions themselves become "laws" and have the same authority as the law. British common law system came to North America with British settlers who formed the foundation of the American judicial system. Therefore, our court has its own ability to interpret legal documents and set judicial precedents that form the basis of future court judgments.

The doctrines and rules developed by judges over a certain period of time compared to the Cultural Act of the Common Law Civil Code System are "legal precedents" of the common law system. The common law system is derived from common law in the UK and can be found in many parts of English-speaking world such as Australia, Canada, United Kingdom, United States, Wales and other countries.
